Agreement to terms

This document is an electronic record in terms of the Indian Contract Act 1872; the Information Technology Act 2000, the rules made thereunder; and the amended provisions pertaining to the electronic records in various other statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. 

We, VecRep Technologies Pvt. Ltd., are registered at, Plot No. 57, Industrial Phase 1, CHANDIGARH 160002 INDIA hereinafter referred to as VecRep.

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and VecRep (“we,” “us” or “our”), concerning your access to and use of the vecrep.com website, vecrep.in website, progressive web application as well as any other media form, media channel, emails, SMS, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). 

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason.

We will alert you about any changes by updating the “Last Updated” date of these Terms and Conditions, and you waive any right to receive specific notice of each such change. 

It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms and Conditions by your continued use of the Site after the date such revised Terms and Conditions are posted. 

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. 

Accordingly, those persons who choose to access the Site from other locations do so on their initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. 

Terms and Conditions of Use

By using the website, you agree to these Terms of Use together with any additional terms, conditions, notices, and disclaimers included on the Website, therefore please read these Terms of Use carefully. If you object to any of these Terms of Use (including any subsequent amends or modifications) or become dissatisfied in any way with your use of the Website, your only recourse is to discontinue usage of the Website.

Overview

VecRep (VR) is an aggregator platform that connects vehicle owners (drivers) (specifically 2 wheeler & 4 wheeler) with their nearby garage (mechanics) in their locality, based on the specific need, customer (driver) can view the profile of the garage; compare the prices and then book the available slot with any garage listed on VecRep Technologies Private Limited (VRT) (“We”). We are a limited company registered in India and Chandigarh and have our registered office at, Chandigarh, India. Our main trading address and principal place of business is also located at this same address.
To use the Website you must agree and allow to receive communications via, email, text, and phone from VR to allow Bookings to be completed. Also, you should allow or give access to your location so that VR can show you the list of all the nearby located garages based on your specific needs.

When you make and confirm a Booking over the Website and call, the chosen Garage will be sent your booking details and you will be sent their details via the text or email you have provided. Please make sure we are on your safe senders’ list and not filtered to junk mail. The VecRep Auto Advisor (customer representative) will contact you to resolve all your queries and concerns. Should the Garage not be able to undertake the Booking or rejects the booking we will endeavour to find you an alternative Garages based on your requirement and time slot or you can do the same even from your side as well.

You will have multiple payment options, you can pay the final amount to the garage owner directly (COD) or even you can pay to VecRep through online modes (cards, wallets, bank transfer, UPI, etc.) based on the final invoice generated for all works undertaken in the normal way under the terms and conditions of business and you have the option to pay once you have received the invoice i.e. after the work is done. At VecRep you have an option of “Book Now Pay Later” i.e. you can pay an online booking fee (advance fee) of Rs. 99 to VecRep while placing your order to confirm your slot with the chosen garage and the rest of the amount can be paid (either online to VecRep or directly to the garage) based on the final invoice once the work is completed.

We understand that an emergency can arise all of a sudden & in such a situation if you need to revise/modify your Booking then VecRep always gives you the option to reschedule your booking with the chosen garage on the next available date & time slot by justifying the reason on the website or contact our customer support directly so that we can take immediate steps to help you with the same. It is really important as the Garage will be expecting you and have allocated a person to work on your vehicle.

VecRep is not responsible or liable for:

The nature or suitability of any agreed or offered Service by the Garage or over the Website, nor the suitability of a Garage in providing Services offered.

If you check the garage from the VecRep website and directly visit the garage to get your work done, then VecRep won’t be responsible for those cases.

If you take any additional service or repair from the garage (other than what you have ordered from the website) then VecRep won’t be responsible for that additional work.

You acknowledge and accept that you release VecRep from any liability, claim, or damages of any kind that may arise from you using either the Website or Garage Services.

By using Platform, you affirm that you are at least 18 years of age and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, warranties set forth in the Terms and Conditions, and to abide by and comply with the terms stated therein. Registration of User in the Platform is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents, or person with unsound mind etc. are not eligible to use the Platform. By accessing the Platform or by accessing any of the Services or Content on any other Authorized Device, it is deemed that the User has read and understood and accepted these Terms.

If you will be using the Services on behalf of an organization, you agree to these Terms on behalf of that organization and you represent that you have the authority to do so.

REGISTERING AS A DRIVER / RIDER

These Terms & Conditions (together with the documents referred to in them) govern your use of our website and all related sites, services, applications, and tools, which we operate from time to time.

These Terms & Conditions apply to any person registering as a “user” on the VecRep, or using the VecRep Services or placing orders/booking slots with the garages as a user (a “Driver/Rider”). If you are registering to use the VecRep Service and website as a mechanic/garage, or you are using the VecRep Service as a mechanic/garage (a “Mechanic/Garage”

You will not access the Platform, and/or its Services, or the personal information of other Users, available on the Platform in order to build a similar or competitive website, product, or service.

By using the VecRep Services you confirm that you accept these Terms & Conditions and agrees to abide by them.

REGISTERING AS A USER (DRIVER / RIDER)

In order to get benefit from all the features of the VecRep Services available to a user(Drivers/Riders), you will need to register with us as a customer by following the online prompts. You will be asked to provide certain information about yourself including your name, phone number, email, location, etc.

You must ensure that the information provided by you on registration is correct, complete, and not misleading. You should also inform us promptly of any changes to the information that you have provided, by updating your details, so we can communicate with you effectively.

By registering as a user you are forming a contract with us. The contract between us will consist of your registration details, these Terms & Conditions, and our Privacy Policy. Unless we have expressly stated otherwise, in the event of any conflict or inconsistency between these Terms & Conditions and our Privacy Policy or Feedback Policy, or any other document or legal notice published on our Service from time to time, these Terms & Conditions shall take precedence.

PROVISION OF SERVICES TO DRIVERS/RIDERS (Customers)

Following registration, we will make certain services available to you. 

The services will include the ability to search for your vehicle needs from the list of automotive repair or servicing work, view, check & compare the verified & available Mechanic/Garage in your locality specialized to do the work for you (a “Job”), the ability to receive quotes from Mechanics/Garages to Jobs or requirements you have posted/entered (“Quotes”), option to book a slot with the garage based on your preferred date & time, check all the real-time updates (“Live Notification”), check and approve the inspection report & job card for any additional work, check the invoices & make the payments online and the ability to post feedback/ratings/reviews about any Mechanic/Garage you have used as a result of your use of the VecRep Service (“Feedback”).

You must only book a service if you have a genuine requirement for the work detailed to be performed. 

You must only post Feedback/Ratings about a Mechanic/Garage if you have used them as a result of your use of the VecRep Service. In addition, you must ensure that the content of any Job or Feedback you post complies with the provisions of our Acceptable Use Policy.

After inspection of the vehicle by the Mechanic, Digital vehicle fitness reports, videos/photos, Digital Job-Card will be shared by the chosen garage for your approval on any additional work required. You will have to notify us with the same by giving your response, in the whole process from the time of placing the order till the order is complete VecRep should be involved in every step and you agree that you will not reach out to the mechanic/garage directly listed on our platform for any service or for any additional work mentioned in the Job Card without involving VecRep, as in that case we won’t be taking any responsibility of your vehicle and the quality of service/repair nor we will be liable to provide any after support in those cases, and if such scenario is found, VecRep holds the rights to block the account of the user without any prior notice.

Full details of the services available to the user will be published on www.vecrep.com from time to time. We are continually seeking to develop and improve the services we offer and so we reserve the right, at our absolute discretion, to make changes to any part of the Service without notice.

Although we have asked all users to use VecRep responsibly, we cannot guarantee the accuracy, integrity, or quality of any information you view or receive of our Partner garage. This includes any information contained about details of Garage who are listed in our directory or quality of service you may receive from Garage you avail using VecRep or discounts & offers mentioned in our website or price of services offered by Garages.

User is solely responsible as driver or customer to ensure that he/she has the legal title or right to take the vehicle to the garage, i.e. he should not be bringing stolen vehicles or vehicles used for unlawful acts to the garage and any such acts, he will be solely liable. VecRep is solely an aggregator and connector platform and is in no way liable in such cases

Accurate Information

  • All information provided by a User when making a Booking is provided for the Website to provide a right fit garage at a most affordable price and for the Garage to deliver Services for the User’s vehicle.
  • A User warrants that all information provided by them via the Website is true and accurate and that no information is given or omissions made by the User are intended or likely to mislead or deceive any person or organization. VecRep Technologies Pvt. Ltd. reserves the right at its discretion to request verification of, or verify on your behalf, any information provided by you.
  • Conditions of Use.
  • If you submit a review to us using our Review System, then you agree that we may publish Your review, together with your name, on this and other websites and on any successor website that we may operate from time to time, on such page and in such position as we may determine in our sole discretion.
  • VecRep reserves the right to vary the specifications, rates, rewards, rules, and conditions of any element of the Website at any time without notice. An announcement may be issued either on the Website or via an authorized e-mail but this is not a requirement. Because these Terms of Use may change over time the User is urged to periodically review these terms on the Website. Any dated information that may be included in the content of this Website is published as of its date only, and VecRep will not have any obligation or responsibility to update or amend the information or for the accuracy of any information on the Website.

VecRep may terminate a User’s use of the Website and or cancel any Bookings without notice or reason but particularly (but not limited to) the following:-

  • the information provided by a User is incomplete, invalid, untruthful, or incorrect;
  • a User uses the Website to send Spam;
  • a User provides false information about their identity;
  • a User takes any actions that may undermine the integrity of any feedback or comments system.
  • if a User does not agree to receive communications or notifications from VecRep.

PROVISION OF PAYMENT PLATFORMS TO CUSTOMERS

  • Some services made available for booking to you include the opportunity to make payments facilitated through our service. Such payments will be made using trusted third-party payment gateways.
  • By making a payment through VecRep, you undertake that the credit or debit card details or third-party wallet login credentials that you provide are correct for your credit or debit card, or wallet account and that you have sufficient funds to make the payment for the services booked.
  • We reserve the right to alter prices or services or cease to list services at any time, without prior notice or warning.
  • Based on your specific requirements and needs price of all the listed garages will be shown to you, and once you confirm the order and once the vehicle gets inspected and an online job card is created by the garage/service provider, all the additional work will be mentioned in the job card with additional pricing and will be shared with you for your approval, if you approve any additional work then new order summary will be generated including that additional price and invoice of the same will be shared with you.
  • After receiving the final invoice, you will have multiple payment options (either through online mode or by Cash) to pay and you agree that your vehicle will be handed over to you, only once you have paid all the invoice amount either to VecRep or directly to the service provider.
  • Payment options provided may differ between service providers, and services offered. In cases where cash on delivery (COD) is not available as an option, full payment must be made through a payment option offered to you after the final invoice is generated with all the additional work and pricing before receiving the vehicle back.
  • While placing an order, you have an option of Book Now Pay Later in which you pay a small booking fee (“Advance Pay”) to confirm the booking with your chosen garage, and the pending invoice amount can be paid (online or by cash) either to VecRep or directly to the service provider at the time of service completion. in case of custom orders or emergency roadside assistance rather than asking you for Advance Pay to confirm your booking, we will immediately try to help you out by finding the nearest garage based on your vehicle needs.
  • In cases where a form of online payment is offered and selected, Payment details provided are not stored by VecRep and are encrypted by the payment provider selected to ensure security.
  • In case if you want to go with the online mode of payment, you just need to enter the correct details of your card/wallet/ UPI, etc. and the pending invoice amount will be deducted from your account and you will get confirmation of the same. 
  • We assure you that we will not be misusing your account details or sharing them with any third party, only after your approval the invoice amount will be deducted to maintain security and transparency.
  • If you decide to cancel your booking, please make sure that your ‘BOOKING FEES WILL NOT BE REFUNDED’ but we understand uncertain situations can arise any time but don’t worry at VecRep you always have an option to MODIFY & RESCHEDULE your booking for FREE with the chosen garage for next available date & time. If you have any query our VecRep Customer Executive will be there to resolve your issue.
  • Odds can happen with anyone, and if in any case the Garage is not able to undertake the Booking or rejects the booking, we will endeavour to find you an alternative Garages based on your requirement and availability or you can do the same even from your side as well. In that case, VecRep will refund the complete booking fees and you can place a new booking with a different garage or our executive will discuss with you and place an order on your behalf with your preferred garage based on your availability. 
  • Arrangement scratch-off done before the vehicle is gotten will be qualified for a discount. VecRep maintains all authority to postpone off the undoing expense when considered fitting. Nonetheless, if the crossing out occurs after the vehicle is gotten, no discount will be made.

FEES

1. You agree to Pay to us a booking fees (Advance Pay) for the Services or bookings availed by you, in accordance with the pricing and payment plans presented to you on the Platform (“Fees”). Payment against Fees can be made online through credit Card/internet banking/UPI gateway etc. or any mode of payment which is made available to the User in the Platform. The Fees paid by you is non-refundable, except as provided in these Terms and Conditions.

2. We accept two types of payments; (i) Payment gateway for online mode: Razorpay Payment Gateway Solution for online payment collection (ii) Cash: Payment through cash (cash, UPI, online payment).

3. We reserve the right to alter/modify/suspend/discontinue any terms and conditions associated with the Fee including but not limited to the period, rate, services. Further, we will provide you with advance notice of any change in fees.

4. Payment for the Services by the Users may be processed through the third-party internet payment service providers. By purchasing any Services or placing any booking through the Platform, the User hereby consents and agrees to abide by such third-party internet payment service providers’ applicable terms and conditions and privacy policies. The User agrees and acknowledges that the Company has no responsibility or liability under the terms and conditions and policies of the third-party internet payment service provider. In the event such third-party internet payment service providers’ customer terms and conditions or privacy policies are not acceptable to you, please do not purchase such Services through the Platform

CANCELLATION & REFUND POLICY

VecRep strongly believes in a sincere and transparent approach to its users. This policy terms aims at minimizing instances of user complaints, grievances and disappointments via channelized approach, review and solutions.

With VecRep you get an option of “BOOK NOW PAY LATER” in which you can pay a booking fee (known as “Advance Pay”) to confirm your booking with a garage listed on VecRep, and you can pay the pending amount once the invoice is generated after the work is completed by the chosen garage. You have the option to pay the pending amount to the garage either by cash or can pay VecRep through online mode.

The Company shall revert to every complaint within 48 hours of receipt of the complaint during the business days. Further, the Company shall take best possible efforts to resolve the complaint within 30 days of receipt of the complaint. Any suggestions by Company regarding use of the Services shall not be construed as a warranty.

VecRep gives you the option of last-minute cancellation or modifying your booking but you cannot cancel or reschedule your booking once the time slot you booked has commenced. In certain cases where you don’t show up and if the work has not been initiated by the service provider with whom you placed your booking, then that order will be automatically considered as cancelled after a certain period of duration.

Booking Cancellation Model: The Booking can be cancelled by three means:

  • A booking cancelled by the customers.
  • A booking cancelled by the operations team upon customer’s approval.
  • A booking cancelled by the service provider upon customer’s approval.

Booking Rescheduling Model: The Booking can be rescheduled by two means:

  • A booking rescheduled/modified by the customers.
  • A booking rescheduled/modified by the operations team upon customer’s approval.

Rescheduling/Modification of booking

With VecRep you always get an option to reschedule/modify your booking even at last minute. We understand uncertain situations can arise any time but don’t worry at VecRep you always have an option to MODIFY & RESCHEDULE your booking for FREE with the chosen garage for next available date & time. You can always raise a request of rescheduling/modifying your booking with the chosen garage for the next available date & time and our support team will discuss the matter with you and reschedule/modify your booking after confirming the same with the service provider. VecRep do not charge any extra amount to reschedule/modifying your booking.

VecRep is not liable to refund the booking fees:

If you decide to cancel your booking or in case you don’t show up and if the work has not been initiated by the service provider then the order will be considered as cancelled, please make sure that your ‘booking fees will not be refunded’ , during sudden unexpected cases based on your communication with our support team we will look into the matter closely and then make a decision, final decision of the same relies with the VecRep team only, we understand uncertain situations can arise any time but don’t worry at VecRep you always have an option to MODIFY & RESCHEDULE your booking for FREE with the chosen garage for next available date & time. If you have any query our VecRep Customer Executive will be there to resolve your issue.

VecRep can refund the booking fees only if:

The Garage is not able to undertake the Booking or rejects the booking, we will endeavor to find you an alternative Garages based on your requirement and availability or you can do the same even from your side as well. In that case, VecRep will refund the complete booking fees and you can place a new booking with a different garage or our executive will discuss with you and place an order on your behalf with your preferred garage based on your availability. 

The user can cancel/stop using services of VecRep at any point of time. In case, VecRep needs to send some final settlement amount (if any) to user then VecRep can settle the same within 7 working days.

VecRep’ s policy follows the under noted points:

  • VecRep users are to be treated fairly at all times.
  • Complaints or concerns raised by users are dealt with an open mind, with courtesy and in a timely manner.
  • Users are informed about the channels to escalate their complaints, concerns and grievances within VecRep and their rights if they are not satisfied with the resolution of their complaints.
  • VecRep will take care of all complaints efficiently and fairly as they value each user.
  • All employees at VecRep must work in good faith and without prejudice to the interests of the users.

Users have complete authority to file complaint/ share feedback if they are disappointed by services rendered by VecRep. They can give their complaint/ feedback in writing or email/letter on any social pages of VecRep.

ALERTS PROVIDED BY THE COMPANY

1. The Company provides you with multiple automatic alerts while providing Services.
2. You understand and agree that any alerts provided to you through the Platform may be delayed or prevented by a variety of factors. We will do our best to provide alerts in a timely manner with accurate information. However, we neither guarantee the delivery nor the accuracy of the content of any alert. You also agree that we shall not be liable for any delays, failure to deliver, or misdirected delivery of any alert; for any errors in the content of an alert; or for any actions taken or not taken by you or any third party in reliance on an alert.

THIRD PARTY SERVICES

While availing Services, Users may connect with third-party service providers. The Company is not responsible for, and does not endorse, any third-party services mentioned on the Platform. It is hereby stated that Company shall in no way be responsible for any acts or omissions of third parties. Any transaction, dealings or communication otherwise that the User may have with such third parties are at the User’s own risk and we make no warranties, express or implied regarding the quality or suitability of the services or products of such third-party vendors. You may be redirected to a third-party website upon clicking on such links, these websites will be governed by its privacy policy and terms of use. We shall not be responsible for any transaction or dissemination of information that may take place while accessing these third-party websites.

CONTACT YOU

You agree that we may contact you through telephone, email, SMS, or any other means of communication for the purpose of:

1. Obtaining feedback in relation to Platform or our Services;

2. Obtaining feedback in relation to any other Users listed on the Platform;

Resolving any complaints, information, or queries by other Users regarding your critical Content; and

You agree to provide your fullest co-operation further to such communication by Company.

By submitting suggestions or other feedback regarding our Services/Platform, you agree that we can use and share such feedback for any purpose without any compensation to you and we are under no obligation to keep such feedback confidential.

MECHANIC TERMS & CONDITIONS

These Terms & Conditions (together with the documents referred to in them) govern your use of our website at www.vecrep.com and all related sites, services, applications, and tools, which we operate from time to time.

These Terms & Conditions apply to any person registering as a “driver” on the VR Service, or using the VR Service as a mechanic (a “Mechanic”).
By using the VR Service you confirm that you accept these Terms & Conditions and that you agree to abide by them.

REGISTERING AS A SERVICE PROVIDER (MECHANIC / GARAGE)

To get benefit from all the features of the VecRep Service available to Mechanic/Garage, you will need to register with us as a Garage/Mechanic by following the online prompts. You will be asked to provide certain information about your business including your correct business name, working email and contact details.

In addition, you will need to provide Proof of Address, Bank details, GST number (if any), images of your workshop, garage details, working hours, and an accurate list of services you offer along with their exact pricing (that will be uploaded on VecRep platform), and any other documentation or information that we may consider necessary from time to time, as part of the registration and certification process. 

You must ensure that the information provided by you on registration is correct, complete, and not misleading. You should also inform us promptly of any changes to the information that you have provided, by updating your details, so we can communicate with you effectively.

By registering as a service provider (Mechanic/Garage) you are forming a contract with us. The contract between us will consist of your registration details, these Terms & Conditions, and Privacy Policy. Unless we have expressly stated otherwise, in the event of any conflict or inconsistency between these Terms & Conditions and our Privacy Policy or Feedback Policy, or any other document or legal notice pu blished on our Service from time to time, these Terms & Conditions shall take precedence.

PROVISION OF THE SERVICES TO MECHANICS/ GARAGES

  • Following registration, we will make certain services available to you. The services will include the ability to include details of your business in our directory of mechanics (“Listings”), the ability to view or receive details of jobs/work which have been posted by Drivers/Riders (“Jobs”), and the ability to submit quotes in response to Jobs (“Quotes”), ability to check the pending/ongoing/completed orders, ability to check their ratings/reviews, ability to add/delete any service and change the pricing of any service (after confirmation by VecRep team), and other methods.
  • Please note that Listings must contain contact details for your business, so you will have the ability to communicate with users, once you have accepted any order then you will be shown complete details of the driver, you can communicate with the users to clarify any issues. You must also ensure that any information you post to or transmit via the VecRep Service, including any content contained in Listings and any Quotes and messages, complies with the provisions of our Acceptable Use Policy.
  • The garage agrees that all the communications and the work done by them should be shared with the users (driver/rider) as well as with VecRep and if any garage/mechanic is found not following the policy VecRep hold the right to block their account and is also liable to take strict action against them.
  • No direct communication for completion of any job/work should be done between a garage and a driver or vice-versa.
  • The garage/mechanic holds the responsibility to share the inspection reports, online job cards (mentioning the additional work), working/performance photos & videos, and any other issues to the user for their approval to maintain transparency. Once the job card is approved then only the garage can continue the work as per the requirements mentioned in the job card approved by the user. Once the work is complete then the garage has to change the status of the work to complete so that customer can receive the invoice & complete the payment.
  • Garage has to work hard to satisfy the customer so that they can get the highest ratings & feedbacks for their garage and if at any point VecRep feel that the garage is working or treating the customers unethically or unprofessionally the VecRep holds the right to immediately remove that service provider from the platform.
  • Full details of the services available to Mechanics via the VecRep Service will be published on our website from time to time. We are continually seeking to develop and improve the services we offer and so we reserve the right, at our absolute discretion, to make changes to any part of the VecRep Service without notice.

OUR RESPONSIBILITIES TO YOU

We will provide VecRep Service to you using reasonable skill and care and under these Terms & Conditions. However, if you use the VecRep Service as a Mechanic/Garage you acknowledge and agree that the services we provide are subject to the following limitations and disclaimers:
You acknowledge and agree that we will enable Mechanics/Garages to register and get listed based on criteria that we (in our absolute discretion) may determine from time to time. In addition, we do not provide any guarantee that registering as a Mechanic will result in you being able to submit Quotes, or in Quotes being submitted on your behalf, about any Jobs, or about any particular volume of users or business. Nor can we guarantee that your use of the VecRep Service will result in you winning any work or any particular volumes of work.

We have asked all users to use the VecRep Service responsibly and to provide accurate information but cannot guarantee the accuracy, integrity, or quality of any Jobs or other material which is posted by third parties (including users).

By registering as a garage you also understand and agree that users who have used your services will be able to provide feedback and we may give you a rating based on the treatment they have received. Whilst we have asked all users of the Services to act responsibly, we do not actively monitor, check or verify Feedback that is posted. Accordingly, you acknowledge and agree that we (VECREP TECHNOLOGIES PRIVATE LIMITED)  shall not have any responsibility to you or liability to you for any Ratings/Feedback which is posted by any user and we will not usually become involved or intervene in complaints or disputes concerning Feedback, although we reserve the right to do so in exceptional circumstances. You may, if you feel that Feedback is misleading or libellous, you have the right to contact and discuss with the user about it or with VecRep team us and we will investigate about it but we shall not be obligated to take any action.

YOUR RESPONSIBILITIES

You agree to abide by these Terms and Conditions when using the VecRep Service and in your dealings with users (Drivers/Riders) You agree that we shall be entitled to permanently or temporarily suspend your access to and use of the VecRep Service and/ or terminate our agreement with you if we have reason to believe that you may have failed to comply with our Terms & Conditions or Code of Conduct, or you are alleged to have done so, or we otherwise believe (in our reasonable discretion) that you have acted in a way which is or could be detrimental the VecRep Service or its reputation. Under these circumstances, we shall not be obliged to give you a refund of any of the fees or amount you have paid.

You agree that you will only use any information concerning any user (Driver/Rider) and any Jobs/Work they have posted, which we provide to you or which you obtain via the VecRep. You agree that you will not use such information for any other purpose without first obtaining the users’ prior consent. You also agree to keep any such information secure and to comply with all applicable laws concerning privacy and data protection about your use of that information. You agree that you will not try to mislead any user or try to communicate with any Driver/Rider directly for any work/job without notifying the VecRep (you agree that you will never convert any VecRep customer as your offline customer by communicating directly about the work if done then VecRep can be held you liable for hampering its services & conditions). You agree that all the work you will do to complete the job will be shared with the customer as well as VecRep and VecRep will generate the invoice on the behalf of your workshop. You agree that you won’t increase the prices for any service you list on the VecRep platform all those are provided to the best of your knowledge. You allow VecRep to offer discounts & the lowest deals to win new customers.

You agree that you will only use the quality assured OEM/OES parts & products to complete any order you receive via VecRep, also you assure that the information of the spares & products mentioned in the What’s Included section of your garage for any particular service is appropriate & you should not compromise with the quality. You give your consent to use the original products that are recommended and if found guilty then you allow VecRep to hold you liable for violating the norms and take strict actions against your garage.

In case if you want the prices of any services listed on the VecRep platform to be changed, make sure you raise a request on your platform or contact VecRep team for any changes.

You will be exclusively liable for checking and confirming the subtleties of any help booking which is presented before you concur on attempt any work for a user and for concurring with the user terms and costs of administrations on which any work will be performed.

You will be answerable for conforming to every material law and guidelines in your dealings with users and for the exhibition and nature of any work which you consent to attempt for any user. If it’s not too much trouble, NOTE: By enrolling as a Mechanic/Garage Partner and by utilizing VecRep you are consenting to reimburse us and hold us innocuous from any expenses, misfortunes, or cases which may result from any data you submit or send by means of VecRep or from any work which you consent to perform for any user.

You agree to hold all responsibility for any of the mishappenings or any extra fault which occurs from your end in the garage/workshop (at any place where job/work is being done) or on the road (during pick up & drop) once the user (driver/rider) hands over his vehicle to you, VecRep just being an aggregator or a facilitator won’t be holding any responsibility or will not be held liable to pay or give compensation to the user, it will be your garage/mechanic which will be held liable in such situations(if any mishap occurs, which will be cross-verified by our team).
You shall be solely responsible for checking and verifying the details of any booking which is transmitted to you via the VecRep before you agree to undertake any work for a user (Driver/Rider) and for agreeing with the user (Driver/Rider) the terms on which any work will be performed.

You shall be solely responsible for complying with all applicable laws and regulations in your dealings with the user and for the performance and quality of any work which you agree to undertake for any Driver.

You agree that you must only use the VecRep Service in connection with your own business and must not (without our prior written consent) use the VecRep for the benefit of any other business providing automotive repair and maintenance services.

*Note: Based on the commission structure agreed to, the garage/mechanic is bound by the same and VecRep will be entitled to receive the commission over and above the booking fees as per discussed or policies set by VecRep.

If a user pays cash directly to you after the work is complete then you allow VecRep to deduct the success fees or order fees in any of the next orders in which the customer chooses your garage for any service and paid the invoice amount online to VecRep, but if you have failed to pay any invoice submitted by us by the due date for payment, then (in addition to any other rights and remedies which may be available to us) you agree that we may charge late payment fees (the “Late Payment Fees”) together with interest on the overdue amount (from the due date up to the date of actual payment). Such interest shall accrue daily and be compounded quarterly.

In these circumstances, we also reserve the right to suspend your access to or use of the VecRep Services until any outstanding sums are paid in full and/ or to terminate our agreement with you.
You agree that we hold the right to terminate your account from our VecRep listing if your quality score is not as per our criteria, if your overall order rejection ratio is more than 10%, your ratings and feedbacks are not appropriate, if you fail to score well in our monthly quality audit score or if you are not following the right procedure to complete the job as per our guidelines.

*PLEASE NOTE: by registering as a Mechanic/Garage and by using the Services you are agreeing that you shall be solely responsible for all products, services, and work you may undertake or perform for any User (Driver/Rider) or supply to any user and your dealings with any Driver/Rider. You agree to indemnify us and hold us harmless from any costs, losses, or claims which we may suffer or incur and which result from any information you submit or transmit via the VecRep Service or from any work which you may agree to perform for any Driver or from your dealings with any Driver or your use of their information.

*PLEASE NOTE: If you use the VecRep Service, you understand, acknowledge, and agree that any Quotes we submit on your behalf will significantly be influenced by the Quoting Data we hold for you. In general, the more up-to-date Quoting Data we hold for you the more accurate the Quotes we submit on your behalf are likely to be. We therefore strongly encourage Mechanics to provide as much Quoting Data as possible and to regularly review the Quoting Data we hold to ensure that it is accurate and up to date. 

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws, foreign jurisdictions, and international conventions. 

The Content and the Marks are provided on the Site for your information and personal use only. Except as expressly provided in these Terms and Conditions, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content, and the Marks.

INFORMATION AND PRIVACY

  • VecRep will not pass any personal details to Garages until a Booking is confirmed. These details will be those provided by the User as part of the Booking consisting of name, address, contact phone number(s), vehicle details & requirements. This is to enable the Garage to correctly identify you and the Booking and can contact in case of any issue. Should you wish for the Garage not to hold your details please ask the Garage to remove them from their files.
  • Any vehicle registration number entered onto the Website can be shared with garages.
  • We hold all personal data under the data protection principles set out in the General Data Protection Regulation.
  • By making a booking over the Website you agree to VecRep providing you with reminders and offerings specific to you and your vehicle.

TERMINATION

We may suspend or cancel your registration and/ or terminate your access to VecRep Service and/ or our agreement with you if you are in breach of these Terms & Conditions or have made improper use of the VecRep Service or we have reason to believe that you may have breached these Terms and Conditions or made improper use of the VecRep Service.

We may also terminate our agreement with you for convenience by giving not less than fourteen (14) days prior written notice to you.

You may cancel your registration at any time by informing us in writing. If you do so you must stop using the VecRep Service.

The suspension, cancellation, or termination of your registration and your right to use the VecRep Service shall not affect either party’s statutory right or liabilities.

ACCEPTABLE USE POLICY

VecRep allows users (including Mechanics and Drivers) to create, edit and submit material for inclusion on or transmission via the VecRep Services, including (without limitation) by creating Listings, posting Jobs, submitting Quotes for Jobs, posting Feedback, and sending notifications, sending job-cards/photos/videos/inspection reports (“User Content”). Whilst we do not seek to monitor or control the submission of User Content, we do reserve the right to delete, move and edit any User Content submitted where (in our absolute discretion) we consider it prudent or necessary to do so.

You agree to comply with all applicable laws and regulations when using the VecRep Service. You are solely responsible for all User Content you submit for inclusion on or transmission via the VecRep Service. You must ensure that all User Content you transmit via the VecRep Service is lawful and honest. In particular, you must not post or transmit via the VecRep Service any User Content that:

  • is fraudulent, dishonest, or misleading;
  • is unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable or breaches any laws;
  • encourages conduct that constitutes a criminal offence, gives rise to civil liability, or otherwise breaches any applicable laws, regulations, or code of practice;
  • infringes the copyright or other rights of any third party;
  • is technically harmful (including, without limitation, computer viruses or other malicious software or harmful data).

By submitting User Content to us you are granting us a royalty-free, non-exclusive license to use, reproduce, modify, translate, make available and distribute the User Content on or through the VecRep Service to operate the VecRep Service.

PASSWORDS AND SECURITY

If you are registering as a driver/rider then you will be asked either to sign-up/login to your account to use the VecRep services or if you register as a mechanic/garage then you will be asked to provide a valid and current email address and phone number. You will then be receiving a unique ID & password (“ID”) to activate and access your account and use VecRep Service. You must keep your ID confidential and must not disclose it or share it with anyone outside your business or organization. You are responsible for preventing unauthorized use of your ID. If you believe there has been a breach of security such as the disclosure, theft, or unauthorized use of your ID, you must notify us immediately. If we reasonably believe that your ID is being used in any way which is not permitted by these Terms and Conditions, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ID until the issues have been resolved.

LIABILITY

To the fullest extent permitted by law, we exclude all liability to you for any loss of profit, loss of opportunity, loss of earnings, loss of anticipated earnings, or loss of data or for any indirect or consequential losses howsoever arising out of your use of VecRep Service or any fault or problem relating to the VecRep Service or any content received via the VecRep Service.
If we are found to have any liability to you under or in connection with these Terms & Conditions or relating to the VecRep Services more generally, whether, under contract, tort (including negligence) breach of statutory duty, or otherwise, our total aggregate liability to you shall not, in respect of any.

Nothing in these terms of use shall exclude or limit our liability for death or personal injury due to our negligence or fraudulent misrepresentation or for any other liability which cannot be excluded or limited under applicable law.

PROCESSRING AND TECHNOLOGY ISSUES

In the event of errors in processing or Website downtime or any other errors or delays caused to the Website or Bookings as a result of unforeseen technical difficulties associated with servers, data hosting centre, internet service provider, or any other reason, VecRep reserves the right to take such action as it considers necessary about the Website.

PRIVACY AND COOKIES

The VecRep platform includes areas where you are requested to input information about yourself. Any information you submit to us shall be subject to the terms of our Privacy Policy. We use cookies on our website. By registering use you are consenting to our use of cookies.

GOVERNING LAW

These Terms of Use, access to, and use of the Website and the terms of any disclaimer of warranties and liability are governed by and construed in accordance to Indian Law and any provision of these terms which is void or unenforceable may be severed from these Terms of Use without affecting the enforceability of other provisions.
